These Terms & Conditions (“Terms”) govern your access to and use of the Radiate mobile application, website, and related services (collectively, the “App”), operated by MODERN MIND EARTH LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement.

2. Nature of Services

Radiate provides content related to:

  • Meditation

  • Nervous system regulation

  • Mindset, self-development, and personal growth

  • Journaling prompts, audio content, and educational materials

The App does not provide medical, psychological, psychiatric, therapeutic, legal, or financial advice.

All content is for educational and informational purposes only.

3. No Medical or Mental Health Advice

You acknowledge and agree that:

  • The App is not a substitute for professional medical, mental health, or therapeutic care

  • We do not diagnose, treat, or cure any condition

  • You should consult a qualified professional before making health-related decisions

If you are pregnant, have a medical condition, or experience discomfort while using the App, discontinue use and consult your healthcare provider.

4. Assumption of Risk

You voluntarily assume full responsibility for:

  • Your use of the App

  • Any physical, emotional, or mental outcomes resulting from its use

You agree that you use the App at your own risk.

5. Limitation of Liability

To the fullest extent permitted by law, MODERN MIND EARTH LLC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Use or inability to use the App

  • Reliance on App content

  • Errors, interruptions, or inaccuracies

This includes but is not limited to personal injury, emotional distress, loss of data, or loss of profits.

6. Indemnification

You agree to indemnify and hold harmless MODERN MIND EARTH LLC, its owners, officers, contractors, and affiliates from any claims, losses, damages, liabilities, or expenses arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your misuse of content

7. Intellectual Property

All content, audio, text, branding, logos, designs, and materials are owned by or licensed to MODERN MIND EARTH LLC and protected by intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without written permission.

8. Subscriptions & Payments

If the App offers paid subscriptions:

  • Payments are processed through third-party providers (e.g., Apple, Google)

  • Subscription terms, billing cycles, and cancellations are governed by those platforms

  • We do not control third-party payment systems

9. Termination

We reserve the right to suspend or terminate access to the App at any time, without notice, if you violate these Terms.

10. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.

11. Changes to Terms

We may update these Terms at any time. Continued use of the App constitutes acceptance of the revised Terms.
